You have the right to free appointment of a traffic accident lawyer, to choose a private lawyer and it will be free if certain requirements are met.

Article 76 d of law 50/80 of the insurance contract says:

THE INSURED WILL HAVE THE RIGHT TO FREELY CHOOSE THE ATTORNEY AND ATTORNEY WHO WILL REPRESENT AND DEFEND HIM IN ANY KIND OF PROCEDURE.

 

Therefore, the choice of lawyer is a right that we have granted by law, and insurers cannot oppose it, although they can establish certain limits.

 

First of all, our insurance will not pay for those lawsuits when we have little chance of success, unless the trial is won. That is, if we want to claim for the injuries we have suffered in a traffic accident in which the public authority (Civil Guard, Local Police, ...) as eyewitnesses give us the blame, unless we obtain a favorable judgment, our The insurance company will not reimburse the fees of the private attorney or the legal costs.

 

Nor are we entitled to the reimbursement of fees derived from the free appointment of a lawyer if the fault of said accident is the driver of the vehicle in which we travel.

 

QUALITATIVE LIMIT : All insurance companies allow the insurance owner and the insured driver to choose an attorney.

Exception: There are insurance companies that those drivers not declared in the policy and who have less than twenty-five years and / or less than two years of driving license are not covered.

 

QUANTITATIVE LIMIT : Each insurance company sets a maximum limit for the refund of legal fees. The amount ranges between 600 euros and 3,000 euros.
